Limited Warranty

What Is Covered: Summit Fluid Systems. (“Summit”) warrants to the original retail purchaser that the Summit product covered by this limited warranty statement, if purchased directly from Summit in the United States, conforms to the manufacturer’s specifications and will be free from defects in workmanship for a period of one (1) year from the date of manufacture. Summit warrants that the ink will perform in the equipment denoted on the specific product’s specifications.

What This Warranty Does Not Cover: This warranty does not apply to modifications to the Summit product. This warranty covers only normal use in the United States. This warranty is not transferable. This warranty does not cover any damages not caused by Summit products. This warranty does not cover damage caused by other products. This warranty does not cover when Summit products are used in conjunction with any other inks. Summit will not be liable for labor or material costs associated with production, application, equipment downtime, or any other damages including loss of profits or potential business sales, arising out of a warranty claim. The consumer is responsible for securing the equipment and the production/printing environment to prevent damage from potential cross-contamination or other damages arising from warranty claim. Summit is not responsible for damages that arise from negligence including ink spills outside printer and/or improper maintenance, care, or repair of equipment during operations.

Summit is not responsible for warranty service should the Summit labels be removed or should the product fail to be properly maintained or fail to function properly as a result of misuse, abuse, improper installation, neglect, improper shipping, damage caused by disasters such as fire, flood, and lightning, improper electrical current, software problems, or unusual interaction with non-Summit products. If a claimed defect cannot be identified or reproduced, you will be held responsible for the costs incurred.

What Summit Will Do To Correct Problems: Should your product prove defective during the warranty period, please email sales@summitinks.com for warranty instructions and return authorization. A service technician will provide telephone diagnostic service to determine whether the product requires service and in the event that further investigation is needed, an on-site visit from a Summit service technician is mandatory to proceed with the warranty claim. Failure to request pre-authorization for any warranty request will automatically deny the warranty claim.

If the product is proven to be defective, Summit will, at its option, exchange the product without charge and at Summit’s discretion, provide warranty repair or replacement of any printhead or parts that fail as a proven direct result of ink products provided during the period of Summit’s warranty excluding consumable parts (i.e. wipers, S-dampeners, filters, pumps, etc.).

Summit’s liability under the limited warranty does not exceed the cost of replacement parts directly affected by Summit products and the travel expenses attributed to a service technician’s labor in the replacement of damages when damages are proven to be attributed to Summit products. In the event that the Summit service call was unrelated to Summit products, then the customer will be charged a fee for the service call with a minimum cost of the travel expenses incurred.

If Summit authorizes an exchange for the defective product, Summit will ship a replacement product to you, freight collect, so long as you use an address in the U.S. (excluding Puerto Rico and U.S. Possessions). Shipments to other locations will also be freight collect. You are responsible for securely packaging the defective unit and returning it to Summit within five (5) working days of receipt of the replacement. Summit requires a debit or credit card number to secure the cost of the replacement product in the event that you fail to return the defective one. When warranty service involves the exchange of the product or a part, the item replaced becomes Summit property.

THE WARRANTY AND REMEDY PROVIDED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. SOME LAWS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF THESE LAWS APPLY, THEN ALL EXPRESS AND IMPLIED WARRANTIES ARE LIMITED TO THE WARRANTY PERIOD IDENTIFIED ABOVE. UNLESS STATED HEREIN, ANY STATEMENT OR REPRESENTATIONS MADE BY ANY OTHER PERSON OR FIRM ARE VOID. EXCEPT AS PROVIDED IN THIS WRITTEN WARRANTY, NEITHER SUMMIT, INC. NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY LOSS, INCONVENIENCE, OR DAMAGE, INCLUDING DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR INABILITY TO USE THE SUMMIT PRODUCT, WHETHER RESULTING FROM BREACH OF WARRANTY OR ANY OTHER LEGAL THEORY.
